1.
Replacing
Section 8.7 with:
Notwithstanding
the Edmonton Design Committee Bylaw 14054, Development Permits within this
Provision for all principal buildings as well as the Publicly Accessible
Private Park described in Section 9.4(a) of this Provision and the Transit
Plaza described in Section 9.4(b) of this Provision shall be reviewed by
the Edmonton Design Committee.”

In Section
8.1, replacing “buildings types D and E” in the first sentence with “building
types “C1, C2, D and E.”

In Section
9.3(d), replacing “10%” with “20%.”

In Section
8.6, replacing all references to “Area 2” with “Area 2-B.”
5.
Adding a new
subsection to Section 8:
Notwithstanding
the other Development Regulations of this Provision, the Appendices of this
Provision and Section 720.3(2) of the Zoning Bylaw, in the event that the
owner does not obtain a Development Permit and commence construction of a
minimum of one principal building in Area 2-A under a valid Development
Permit within 15 years of the passage of the Bylaw adopting this Provision,
development within Area 2-A shall be in accordance with this Provision,
except that:
a.
the maximum
Height of any building within Area 2-A shall be 20.0 m; and
b.
the maximum
number of Dwellings shall be 420.”
6.
Replacing
Section 8.4 with:
Prior
to the issuance of the first Development Permit, the applicant shall
demonstrate to the satisfaction of the Development Officer that the owner
has carried out good faith discussions with the Holyrood Community League
and the Strathearn Community League regarding entering into a Good
Neighbour Agreement, which shall include, but not be limited to:
a.
Review of any
conceptual development proposals;\
b.
Reasonable
notice of an application for a development permit;
c.
Initiatives to
provide opportunities to integrate existing and new residents with the
community;
d.
Communication
protocols during construction, including owner contact for inquiries;
e.
Review of
north TIA and resulting decisions related to parking and traffic flow;
f.
Review of the
sun shadow/wind impact studies and potential mitigation measures; and
g.
Review of
landscape plans.
7.
Adding “and
directional flow” after “location” in the second sentence of Section 8.5.
8.
In Section
8.5, replacing the “.” at the end of the first sentence with “and including
consultation with the Holyrood Community League.”

- 93 Avenue NW by designating the lane at the rear of development
southbound only and the two east/west lanes attached to the north/south
lane as westbound only until it can be assessed at time at the time of

options for enhancing public realm and pedestrian safety near the site

Feasibility of Adding
Indoor Non-Tobacco Combustion Use to the Edmonton Zoning Bylaw (J. Dziadyk)

Councillor
J. Dziadyk stated that at the August 21, 2018, City Council meeting, he would
move the following
That
Administration, in the lens of public health and occupational health and
safety, prepare a report on the feasibility of adding the use of “Indoor
Non-Tobacco Combustion” as an option for businesses, within the Edmonton
Zoning Bylaw. This would build on the previously completed work of adding the
definition of “Cannabis Lounges” to the Zoning Bylaw. The report should
consider age and advertisement restrictions, ventilation requirements, as
well as tourism considerations. The definition for “Indoor Non-Tobacco
Combustion” can be defined by Administration (and the label can change for
accuracy), but it should include the ability for existing restaurants, coffee
shops, and similar commercial ventures to add either Shisha Waterpipe use, or
the Combustion of Cannabis, to existing operations. The intent is to not
treat shisha and cannabis as similar, but to recognize that there is demand
to smoke both of these non-tobacco products in commercial establishments. The
report should comment on other City bylaws that would be required to be
amended, if adoption of this use proceeds.
